What is a cross lease?

A cross lease is a form of property ownership where multiple owners share ownership of the underlying land and each owner leases the area occupied by their dwelling. Rights and responsibilities are usually linked to the title documents and the flats plan. Cross lease titles can work well, but they may also create added complexity when changes are made to buildings, access areas or common land.

What is a flats plan?

A flats plan is the survey plan that shows the footprint and location of the dwellings and relevant site layout on a cross lease property. It forms an important part of the title record. If buildings have been altered, extended or added to since the plan was created, the flats plan may no longer accurately reflect what exists on site.

Why update a cross lease or flats plan?

If improvements are not shown on the registered flats plan, this can create issues during a property sale, refinancing or future development planning. Lawyers, buyers and lenders often review title documents carefully, and outdated plans can lead to delays or requests for clarification.
Common examples include:
  • Conservatories or enclosed decks
  • Carports or garages
  • Extensions or altered building footprints
  • Additional structures
  • Changes affecting access or shared areas
We can survey the current improvements and help progress the required update process with the relevant parties.

Converting cross lease to freehold

Many Auckland owners now explore converting cross lease titles to freehold ownership. This can simplify ownership arrangements, provide clearer boundaries and make future building or redevelopment plans easier to manage.
A conversion usually involves agreement between affected owners, survey work, legal documentation and approvals/lodgement through the relevant authorities like LINZ. We can assess the property layout, explain the surveying requirements and work alongside your lawyer and consultant team to help progress the process.

Case Study: Cross lease/flats plan update - Ringwood Street, Torbay

Our client reached out to us in early February 2026 to update their cross lease title following the demolition of their old flat and the completion of a new house on the site. Shortly after, we conducted a site visit to locate and measure the new house. We then prepared a new flats plan and submitted an application for resource consent to the council.
The council granted consent about one month after our initial site visit. Around a month later, the council issued the 223 and 224f certificates. Finally, Land Information New Zealand (LINZ) provided survey approval on April 20th, 2026. In total, it took just over two and a half months from our first contact with the client to obtaining survey approval.

Often yes. Shared accessways, parking areas or common land may form part of the overall title arrangement. Understanding who has rights to use these areas is important before fencing, landscaping or making changes.

Often yes, but changes to the building footprint, additional structures or alterations affecting common areas may require the flats plan to be updated and, in some cases, consent approvals. It is best to check before work begins.

Timeframes vary so talk to us about your specific project - it can also depend on Council and LINZ processing times.

For many significant changes, especially freehold conversion or alterations affecting shared areas, agreement from the other owners may be required. The exact requirements depend on the title documents, proposed work and legal advice for the property.

“Defective cross lease title” is a common informal term used when the registered flats plan no longer matches the buildings or site layout, often because additions or alterations were made after the title was created. This can sometimes create issues during a sale, refinance or future development plans. We can advise whether an update is needed and help guide the survey process.
